LOS ANGELES, CA – Veterans News Service Los Angeles http://www.vnsla.com/about is looking for Veterans who are currently receiving inpatient hospital, nursing home, or assisted living care on the Campus of the West Los Angeles VA Medical Center who feel they are being physically and/or and/or emotionally and/or verbally and/or sexually abused by VA Staff or Contracted Staff. Abuse and Neglect is also known as Malpractice. Friends and Relatives of inpatient Veterans and VA Staff can also Report Abuse and Neglect of an inpatient Veterans to us.

The Veteran must be willing to go on record with his or her name and photo and have at least some kind of documentary or witness testimonial evidence from VA Staff, Friends, Relatives or from other VA Patients as to any allegations you make about Patient Abuse or Neglect. This also applies to any VA Employees or Friends or Relatives of inpatient Veterans who want to Report Abuse or Neglect of an inpatient Veteran to us.

If any of the above applies to you, please contact us at vnsla@yahoo.com and we will set up a recorded phone interview with you to get the information and make an assessment of your allegations. If we determine that there is enough evidence to substantiate your allegations and you are ambulatory, we will set a time and place near the VA Campus to meet with you in person.

If you are not ambulatory, we will interview you in person at the VA as long as you are willing to sign a written consent provided by the VA giving us permission to interview you. Or, if you prefer, we can contact The State of California Adult Protective Services on your behalf and let them conduct an investigation. Or you can contact them yourself. http://www.cdss.ca.gov/agedblinddisabled/PG1298.htm

We will also provide you with a list of Federal Tort Claim Attorneys you can contact should you feel you want to Sue the VA for Patient Abuse or Neglect which is considered pursuant to the Federal Tort Claims Act. Whether any of these Attorneys accept your Case or not is up to them.

Veterans are also permitted to file a Section 1151 Claim for Service-Connected Disability for Abuse and Neglect perpetrated by VA Staff against them in addition or in place of filing a Federal Tort Claim. There is no time limit to file a Section 1151 Claim but there is a 2-year time limit to file a Federal Tort Claim. A Section 1151 Claim can be filed by an Attorney, a Veterans Service Officer, or by the Veteran himself or herself. http://www.nolo.com/legal-encyclopedia/when-veteran-is-injured-the-va-the-federal-torts-claims-act.html
